Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders placed via our online shop. Our online shop is aimed at both consumers and businesses.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business is a natural or legal person or a partnership with legal capacity that acts in the exercise of its trade or independent professional activity when entering into a legal transaction.

2. Contractual Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with Phoenix der Lebenskraft e.U.

The presentation of products in the online shop does not constitute a legally binding offer but a non-binding online catalog. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. By clicking the order button, you submit a binding order for the items in your cart. Confirmation of receipt of the order is sent immediately by email.

When the contract is concluded depends on the payment method you choose:

Advance payment
In the case of advance payment, the contract is concluded when we provide our bank details and request payment. If payment is not received within 10 calendar days of the order confirmation, despite a reminder, we withdraw from the contract and the order becomes void.

Credit card
When placing the order, you submit your credit card details. After successful authorization, the payment is processed and your card is charged. The contract is concluded when your card is charged.

PayPal / PayPal Express
During the ordering process, you are redirected to the PayPal website. After confirming the payment, the transaction is completed and the contract is concluded upon our acceptance.

3. Contract Language, Storage of Contract Text

The language available for the conclusion of the contract is German.

We save the contract text and send you the order details and our Terms and Conditions by email. For security reasons, the contract text is not permanently accessible online.

4. Order

After submitting your order, you will receive a confirmation email. By placing your order, you agree to our Terms and Conditions and the stated prices.

The contract is fulfilled through the shipment and confirmation of the paid goods.

If you request any deviations from the standard ordering process, these must be confirmed in writing or by email.

5. Delivery

Unless otherwise agreed, shipping is usually carried out within 2–3 business days after receipt of payment. If no separate shipping address is provided, delivery will be made to the billing address.

Failure to accept a delivery does not affect the validity of the purchase contract. The buyer bears the costs for any reshipment (e.g., due to incorrect or incomplete addresses) and for returns due to non-acceptance.

6. Shipping Costs

We only deliver via shipping. Self-collection is not possible.
We do not deliver to parcel stations.

We ship via DPD and Amazon Multi-Channel Fulfillment (MCF). Depending on the destination, Amazon MCF may use various delivery services (e.g., DHL, Hermes, or Amazon Logistics).

7. Prices

All prices include the applicable Austrian or German VAT.

Shipping costs are additional, as listed in our Shipping and Payment Information.

We reserve the right to correct any obvious errors or misprints. In such cases, you have the right to cancel the order.

8. Payment

The following payment methods are available in our shop:

Advance payment: Delivery occurs after receipt of payment.
Credit card: The card is charged upon placing the order.
PayPal / PayPal Express: Payment is made directly via your PayPal account.

9. Retention of Title

The goods remain our property until full payment has been received.

10. Right of Withdrawal

You have the right to cancel the contract within 14 days without providing a reason. Opened products or damaged original packaging are excluded.

The period begins upon receipt of the goods. Sending the cancellation in time is sufficient to meet the deadline.

The buyer bears the return shipping costs. Unpaid returns will not be accepted.

11. Voluntary Return Policy

In addition to the legal right of withdrawal, we offer a voluntary 30-day return policy, provided the goods are in perfect condition. Opened or used products are excluded.

12. Data Protection

Your data is stored and processed in compliance with all applicable data protection regulations. Details can be found in our Privacy Policy.

13. Code of Conduct

We adhere to Good Manufacturing Practice (GMP) in accordance with EU law:

14. Transport Damage

Please report any transport damage to the delivery service immediately and contact us as soon as possible. Your statutory rights remain unaffected.

15. Warranty & Guarantees

The statutory warranty law applies. Additional guarantee conditions may be available for individual products.

16. Product Shelf Life

The expiration date is indicated on the product label. Please store products in a cool, dry, and protected place.

17. Liability

We are liable only for gross negligence, intent, and damage to life, body, or health, where legally permissible.

18. Dispute Resolution

The EU Commission provides a platform for online dispute resolution:

We are neither obligated nor willing to participate in a dispute resolution procedure.

19. Severability Clause

If any provision of these Terms and Conditions is invalid, the remaining provisions shall remain in effect.
